This notice describes the Privacy Policy for Gol-fit.com LLC (dba BESS™ Box Fitness) and its officers, directors, employees, agents, and/or other authorized representatives including contractors as well as our Franchisees. Our business address is currently 140 SW 144th Ave. Beaverton, OR 97006. This policy concerns our franchise operations, use of our website, business development operations, and any information from any future affiliated applications or websites. The terms “personal information,” and “personal data” are synonymous terms. The terms “we and “us” are also synonymous and refer to Gol-fit.com LLC.
In use of BESS™ Box Fitness sites, services, products or resources you agree to the terms of this policy. You may cancel or withdraw consent by notifying us as indicated below, however, if you withdraw consent, you may not be able to use our website and we may refuse to provide you with our products or services.
This privacy posting is our current policy which we reserve the right to change at any time.
We currently operate only in the United States and as such we have not posted any Privacy Notices for foreign countries but may do so in the future. We also do not currently offer our franchises in states listed in this website. Our policy will be updated should we offer franchises to any states currently excluded.
Consent
If you submit any personal information or information from third parties (by doing so you represent you have their permission to submit this data), you thereby agree to hold us harmless from and against any claims by such third parties or their representatives relating to our use of such information.
Information we may collect
We may collect information from time to time on our website, apps, or other forms of digital information collection. Your data is used for many reasons including to contact you, to provide you with news, special offers, products, services, requests and inquiries, data analysis, and trends, plus enabling us to analyze the effectiveness of our marketing and advertising programs. If you are a franchisee of BESS™ Box Fitness or a member of a BESS™ Box Fitness Franchise Facility we may compile the following information:
- Your contact information including your name, address, email address, and phone number
- Fitness related information such as height, weight, body fat percentage, certain medical history data, and other pertinent information relative to providing fitness training programs
- Transaction history of purchases or products and services from us, our franchisees, and/or affiliates
- Information regarding training routines, financial transactions with us, our franchisees, and/or affiliates
- Collection of computer data from your web browser using “cookies” as well as obtaining your IP address to enable us to measure website performance
- We also may collect data from alternative sign-ins such as Twitter, Facebook, etc. if you sign in to use our website or apps thru them.
- Results of surveys or questionnaires
From time to time, we may choose to integrate with applications or platforms that would be useful for supporting client fitness goals. You hereby agree to allow us to collect and store such information in our system which you will have the right to access. We are not responsible for the links or the content that third-party websites may have. Some or all of these third-party applications may have their own privacy policies regarding the use and collection of such data and you should review these privacy policies as well as their terms and conditions of service.
We may also allow the integration of social media accounts through our website and collect personal information such as your name, picture, email address, and list of friends/contacts. If you do not want us to use this information you must advise us or if applicable, refrain from utilizing the social media sign-in feature.
Under Age Users
Under COPPA, we do not collect information from anyone under the age of 13. Anyone under such age should not submit any personal data to us in any form. If we discover such information in our files they will be deleted.
Other aspects of your personal information and how to contact us
We strongly suggest you maintain the integrity of your data by keeping your information up to date by promptly and periodically reviewing and editing when necessary. If you have an account with us, you can request it to be deactivated. You can also request a copy of the information on file by emailing us at info@gol-fit.com. Upon receipt, we will send you our request form.
The use of your personal information has many considerations. Our current process includes the following aspects:
- We may use your location data to provide you with information about our franchisees or the location of our trainers
- We may use certain data to provide you with nutrition and training information to help you meet your fitness goals
- We may use your information to develop promotions, advertising, and marketing programs tailored to your particular interests and demographics
- We may provide you with information about our website, apps, or third-party sites that may be helpful to you
- We may use your information to help us conduct surveys, and contests or make you aware of opportunities of interest and/or update you regarding changes in our policies, procedures, or administrative notices
- Your information may be used to assist in the application process in applying for a franchise
- We may use your contact information to provide you with notifications (via, email, text, push notifications, or other electronic utilities) to your mobile device. You may opt-out at any time by notifying us at the email address info@gol-fit.com.
- We may collect information from third-party sites or apps (like MyFitnessPal) where you have information stored that can directly support your fitness program and goals with us or our franchisees. We may integrate such data with our website or other applications but only if allowed or within the policy of the third-party app owner.
- We do not currently share information with third-party websites or with other unaffiliated entities but may do so in the future. If so, our policy will be revised to reflect this change. We may, however, share information with our franchisees and may use beacons to detect that you have entered into a defined BESS™ Box Franchise facility.
Other important Policy processes and pertinent legal considerations:
- We may disclose information about you to others under the following conditions:
- We are required to do so by legal process, law, or statute
- If legally requested by law enforcement
- To enforce our terms of use
- To prevent fraud, suspected illegal activity, protect our property, products & services, and/or our legal rights
- To prevent financial loss or physical harm in conjunction with a legal investigation
- To support required audits or other legal compliance functions
- We will maintain reasonable and prudent security measures to keep your information secure, however, we cannot guarantee our efforts can completely protect your information from malicious unauthorized access or unknown alterations to our website, browsers, or other electronic transmission pathways. There is considerable risk in both the Internet and other information transmission methods that can be comprised. It is critical that you keep passwords and user IDs safe and secure. We will also endeavor to verify your identity before granting access to information about you in our possession.
- Nevada law allows consumers to restrict certain business entities not to sell personal information to third parties to sell or license that information to other third parties. We do not sell your information to anyone. If you are a Nevada resident or Nevada franchisee you may submit a request to ensure your information is not sold. We will endeavor to respond within 60 days of your request. Please advise us via email (info@gol-fit.com) by sending us your name, email address, physical address, and phone number.
- California has certain additional privacy rights for residents of that state including specific rights for those under 18 years of age, designating authorized agents, and other regulations concerning discriminatory practices. Since we do not currently offer franchises in that state, we have not specifically listed those requirements. The state of Virginia also has such laws (“Virginia Consumer Data Protection Act”). As with California, we do not currently offer franchises in Virginia. Should this change in the future, we will update this policy to list and comply with those regulations.
- All communications must be in the English language.
- Fees are not charged for information requests, however, if requests are repetitive, unwarranted, unfounded, or excessive we may issue to you estimated charges for our services to meet such requests.
- We may keep on file credit card, bank account, or other payment information in order to allow us to process financial transactions on your behalf.
- For people trained by us or our franchisees, we may also collect personal medical histories including prescription drugs and supplements to enable us to understand your physical condition in order to develop appropriate fitness programs.
- With regard to the use of “cookies,” we may use them for a variety of purposes including diagnosis of problems, gathering of analytical data, tracking traffic patterns, functionality of apps, or other means to improve and enhance the user experience.
- We may also select third-party vendors to advertise who also use cookies but which will not be linked to any personal information we collect. You are also free to opt out of these websites by contacting them.
- If you are a prospective franchisee, we may do background checks which in selected cases could disqualify an applicant or reveal discrepancies that need to be resolved (for example, a suspended driver’s license). In the case of drug-related substances, all state and federal laws will be followed with regard to testing and hiring decisions.
